These Terms constitute a legally binding agreement between you and mcsÉdition ("we", "us", "our") regarding your use of MonTri.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on your personal mobile device
• Use the Application for personal, non-commercial purposes
• Access and use any features available to you based on your subscription tier

You may not:

• Copy, modify, or distribute the Application
• Reverse engineer, decompile, or disassemble the Application
• Rent, lease, lend, sell, or sublicense the Application
• Use the Application for any illegal purpose
• Remove any proprietary notices from the Application

MonTri is a photo sorting application that allows you to:

• View photos from your device's gallery
• Sort photos by swiping to keep or discard
• Filter photos by date, album, or size
• Permanently delete unwanted photos
• Restore photos before permanent deletion

Important: MonTri operates entirely on your device. All photo processing is done locally, and we do not have access to your photos.

MonTri offers a Premium version with additional features:

• Dark theme
• Ad-free experience
• Unlimited rollback (undo)

Pricing:

• Premium is available as a one-time lifetime purchase
• Prices are displayed in your local currency
• Prices may vary by region and are subject to change

Purchases:

• All purchases are processed through Google Play Store or Apple App Store
• Payment is charged to your account upon confirmation
• Purchases are non-refundable except as required by applicable law

You are responsible for:

• Backing up your photos before using the Application
• Understanding that deleted photos cannot be recovered after permanent deletion
• Using the Application only for your own photos
• Respecting copyright and the privacy of others
• Complying with all applicable laws and regulations

Recommendations:

• Review photos in the trash before permanent deletion
• Use the undo function if you accidentally discard a photo
• Keep regular backups of important photos

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The Application is provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of the Application

We shall not be liable for:

• Any accidental deletion of photos
• Loss of data or photos
• Any indirect, incidental, special, or consequential damages
• Any damages arising from your use of the Application

Our total liability shall not exceed the amount you paid for the Application (if any) in the twelve months prior to the claim.

You agree to indemnify, defend, and hold harmless mcsÉdition and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Application
• Your violation of these Terms
• Your violation of any rights of a third party

These Terms are effective until terminated. We may terminate or suspend your access to the Application at any time, without prior notice, for any reason.

Upon termination:

• Your license to use the Application will immediately cease
• You must uninstall and destroy all copies of the Application
• Provisions that by their nature should survive will continue to apply

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Application after changes constitutes acceptance of the modified Terms.

We will notify you of significant changes through:

• An in-app notification
• Updating the "Last update" date on this page

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through:

• Good faith negotiation
• Mediation
• If necessary, the courts of Canada

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Sous reserve de votre conformite a ces CGU, nous vous accordons une licence limitee, non exclusive, non transferable et revocable pour :

• Telecharger et installer l'Application sur votre appareil mobile personnel
• Utiliser l'Application a des fins personnelles et non commerciales
• Acceder et utiliser toutes les fonctionnalites disponibles selon votre niveau d'abonnement

Vous ne pouvez pas :

• Copier, modifier ou distribuer l'Application
• Faire de l'ingenierie inverse, decompiler ou desassembler l'Application
• Louer, preter, vendre ou sous-licencier l'Application
• Utiliser l'Application a des fins illegales
• Supprimer les mentions de propriete de l'Application

MonTri est une application de tri de photos qui vous permet de :

• Visualiser les photos de la galerie de votre appareil
• Trier les photos en glissant pour garder ou jeter
• Filtrer les photos par date, album ou taille
• Supprimer definitivement les photos non desirees
• Restaurer les photos avant la suppression definitive

Important : MonTri fonctionne entierement sur votre appareil. Tout le traitement des photos est effectue localement, et nous n'avons pas acces a vos photos.

MonTri propose une version Premium avec des fonctionnalites supplementaires :

• Theme sombre
• Experience sans publicite
• Annulation illimitee (rollback)

Tarification :

• Premium est disponible en achat unique a vie
• Les prix sont affiches dans votre devise locale
• Les prix peuvent varier selon la region et sont susceptibles de changer

Achats :

• Tous les achats sont traites via Google Play Store ou Apple App Store
• Le paiement est debite de votre compte lors de la confirmation
• Les achats ne sont pas remboursables sauf si la loi applicable l'exige

Vous etes responsable de :

• Sauvegarder vos photos avant d'utiliser l'Application
• Comprendre que les photos supprimees ne peuvent pas etre recuperees apres la suppression definitive
• Utiliser l'Application uniquement pour vos propres photos
• Respecter les droits d'auteur et la vie privee d'autrui
• Respecter toutes les lois et reglementations applicables

Recommandations :

• Verifiez les photos dans la corbeille avant la suppression definitive
• Utilisez la fonction d'annulation si vous jetez accidentellement une photo
• Gardez des sauvegardes regulieres de vos photos importantes

DANS LA MESURE MAXIMALE PERMISE PAR LA LOI APPLICABLE :

L'Application est fournie « EN L'ETAT » sans garantie d'aucune sorte. Nous declinons toute garantie, expresse ou implicite, y compris mais sans s'y limiter :

• Qualite marchande
• Adequation a un usage particulier
• Non-contrefacon
• Exactitude ou fiabilite de l'Application

Nous ne serons pas responsables de :

• Toute suppression accidentelle de photos
• Perte de donnees ou de photos
• Tout dommage indirect, accessoire, special ou consecutif
• Tout dommage resultant de votre utilisation de l'Application

Notre responsabilite totale ne depassera pas le montant que vous avez paye pour l'Application (le cas echeant) au cours des douze mois precedant la reclamation.

Vous acceptez d'indemniser, defendre et degager de toute responsabilite mcsÉdition et ses dirigeants, administrateurs, employes et agents contre toute reclamation, dommage, perte ou depense (y compris les honoraires d'avocat raisonnables) resultant de :

• Votre utilisation de l'Application
• Votre violation de ces CGU
• Votre violation des droits d'un tiers

Ces CGU sont en vigueur jusqu'a leur resiliation. Nous pouvons resilier ou suspendre votre acces a l'Application a tout moment, sans preavis, pour quelque raison que ce soit.

Lors de la resiliation :

• Votre licence d'utilisation de l'Application cessera immediatement
• Vous devez desinstaller et detruire toutes les copies de l'Application
• Les dispositions qui, par leur nature, doivent survivre continueront de s'appliquer

Nous nous reservons le droit de modifier ces CGU a tout moment. Les modifications entreront en vigueur immediatement apres leur publication. Votre utilisation continue de l'Application apres les modifications constitue une acceptation des CGU modifiees.

Nous vous informerons des changements importants par :

• Une notification dans l'application
• La mise a jour de la date de « Derniere mise a jour » sur cette page

Ces CGU sont regies et interpretees conformement aux lois du Canada, sans tenir compte de ses dispositions en matiere de conflit de lois.

Tout litige decoulant de ces CGU sera resolu par :

• Negociation de bonne foi
• Mediation
• Si necessaire, les tribunaux du Canada

Si une disposition de ces CGU est jugee inapplicable, les autres dispositions resteront pleinement en vigueur. La disposition inapplicable sera modifiee dans la mesure minimale necessaire pour la rendre applicable.
